General Terms and Conditions (GTC) of the Digital City Rally Offer of Schmidt Jonas & Traganis Adrian GbR
§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all contracts between Schmidt Jonas & Traganis Adrian GbR, hereinafter referred to as the “Provider,” and a consumer or business customer, hereinafter referred to as the “Customer,” for the booking and execution of digital city rallies and other tours via the Provider’s brands and channels, in particular via unboxedtactics.de, teamrallyes.com, rallye4schools.com, app.unboxedtactics.de as well as all other sales platforms.
(2) The version of the GTC valid at the time of booking shall be decisive.
(3) Deviating or supplementary agreements shall only apply if made in writing between the Provider and the Customer. Verbal side agreements are invalid.
§ 2 Conclusion of Contract
(1) The services presented on the Provider’s websites and advertising materials do not constitute a binding offer in the legal sense, but an invitation without obligation for the Customer to submit an offer.
(2) By completing the order process, the Customer submits a legally binding offer to conclude a contract.
(3) The contract is concluded only upon acceptance of the offer by the Provider. Acceptance takes place through a booking confirmation by e-mail, which also contains the access data for the tour.
(4) The Customer is obliged to check receipt of the confirmation e-mail, including their spam folder. If the Customer has not received a confirmation within 12 hours, they must notify the Provider without delay, whereupon the Provider will attempt delivery again.
§ 3 Subject Matter of Performance
(1) The Provider renders the service in the form of a digital, self-guided city rally or tour. There is no in-person support or on-site accompaniment.
(2) By purchasing, the Customer receives a simple right of use to carry out the booked tour once within a single, continuous day. Access is valid for a period of three years after booking. Once the tour is started, the access expires.
(3) Self-guided execution requires that the Customer, at their own expense, provides an internet-enabled smartphone with sufficient battery capacity, a stable internet connection, and appropriate technical equipment.
(4) The Provider endeavors to update the tours regularly. There is no entitlement to full accessibility of all stations. As long as at least 75% of the stations are accessible, the service is deemed to have been properly rendered.
(5) The Provider reserves the right to change, further develop, or adapt the web app and all associated technical systems at any time in a manner reasonable for the Customer. The Provider may also temporarily or permanently discontinue the app without having to inform Customers individually. In this case, information will be published on the website unboxedtactics.de for at least three months.
§ 4 Prices and Payment
(1) The prices stated in the booking process include statutory VAT for consumers and, where applicable, are plus VAT for business customers. The applicable price display results from the respective offer.
(2) The payment claim arises upon successful completion of the order process. Payment is made immediately thereafter via the offered online payment methods.
§ 5 Vouchers and Discount Codes
(1) Value vouchers have a statutory validity period of three years from the date of issue.
(2) Discount codes provided in the context of marketing campaigns or voluntary offers without monetary consideration may have shorter validity periods. These are stated in each offer.
(3) Cash payment of vouchers or discount codes is excluded.
§ 6 Rights of Use and Copyright
(1) Upon purchase of a ticket, the Customer receives a non-transferable, simple right of use to carry out the booked tour for private purposes.
(2) Commercial use, in particular resale, public performance, reproduction or other commercial exploitation, is permitted only with the Provider’s prior written consent.
(3) All rights to content, puzzles, tours and other materials remain with the Provider. Any infringement of copyright will be pursued under civil and criminal law.
§ 7 Liability
(1) Participation in the tour is at the Customer’s own risk and responsibility.
(2) The Customer’s claims for damages against the Provider, regardless of legal basis, are limited to the purchase price of the booked tour. Further claims, in particular for loss of profit, indirect damages or consequential damages, do not exist.
(3) The Provider is liable without limitation only for damages based on intentional or grossly negligent breach of duty.
(4) Any further liability, in particular for property damage or personal injury in connection with carrying out the tour, is excluded.
(5) The Customer must respect third-party rights, in particular comply with traffic rules, use publicly accessible paths, and observe applicable laws. The tour never calls for unlawful conduct.
§ 8 Right of Withdrawal (Consumers)
(1) Consumers have a statutory right of withdrawal of 14 days.
(2) The right of withdrawal expires prematurely if the Customer starts the tour or accesses the digital content before the withdrawal period has ended.
(3) Otherwise, the statutory provisions on the right of withdrawal apply. Withdrawal can be declared informally, e.g., by e-mail to the contact address provided by the Provider.
INSTRUCTIONS ON WITHDRAWAL
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

by means of a clear statement (e.g., a letter sent by post or e-mail) of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal:
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your notice of withdrawal. For this reimbursement we will use the same means of payment that you used for the original transaction; in no case will you be charged fees for this reimbursement.
We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.
You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If you requested that the services begin during the withdrawal period, you shall pay us an appropriate amount corresponding to the proportion of the services already provided up to the point in time when you notify us of the exercise of the right of withdrawal from this contract, compared to the full scope of the services covered by the contract.

§ 9 Cancellations and Rebookings
(1) Cancellations are governed by statutory provisions.
(2) Voluntary goodwill arrangements by the Provider, e.g., rebookings, apply only until the start of the tour and are subject to case-by-case decisions.
(3) After expiry of the three-year period or after the tour has started, there is no entitlement to a refund.
§ 10 Availability
(1) The Provider endeavors to ensure the highest possible availability of the services offered, but cannot exclude interruptions due to maintenance work, further developments, or disruptions.
(2) In the event of temporary technical unavailability, there is no entitlement to a refund; the Customer may complete the tour at a later time.
§ 11 Data Protection
The Provider’s Privacy Policy is available at https://unboxedtactics.de/datenschutzerklaerung and applies in addition to these GTC.
§ 12 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Place of jurisdiction is Munich.
(3) Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision.
